your use of service is subject to your acceptance of and compliance with the following
terms and conditions ("Terms").
By using any of our services you agree that you have read, understood and are bound by the Terms, regardless of how you use the services. If you do not want to be bound by the Terms, you must not use our services. These Terms and various other policies are binding as per the provisions of the Information Technology (Intermediaries guidelines) Rules, 2011 formulated under the Information Technology Act of 2000 in India. In these Terms, references to "you", "User" shall mean the end user accessing the Website, its contents and using the Services offered through the Website, "Service
Providers" mean independent third party service providers, and "we", "us" and "our"
shall mean www.wearnia.com.
Eligibility: By using our website and purchasing products, you confirm that you are at
least 18 years of age and capable of entering into a legally binding contract.
Products and Pricing
Product Descriptions: We strive to provide accurate descriptions and images of our
products. However, due to variations in display settings of our items, the actual product may differ slightly from the pictures shown.
Pricing: All prices listed on our website are in Indian rupees and include applicable
taxes. We reserve the right to change prices at any time without prior notice.
Availability: Product availability is subject to change without notice. We reserve the
right to limit the quantity of any product sold or to discontinue any product at any time.
Payment and Order Processing
Payment Options: We accept a variety of prepaid payment methods, including
credit/debit cards, net banking, UPI etc. Please note that we will charge extra for "Cash on Delivery" (COD) option. All prepaid orders must be in full before processing.
Order Confirmation: After you place an order, you will receive an order confirmation
email. This email serves as an acknowledgement that we have received your order and
are processing it. You will receive order updates via email like order status, tracking
details etc.
Order Processing Time: Orders are typically processed within 3-7 business days.
Processing times may vary depending on product availability and other factors like
public holidays etc.
Shipping and Delivery
Shipping Methods: We offer various shipping options to meet your needs. Shipping
costs is included in the cost of the item.
Delivery Time: Estimated delivery times will be provided at checkout. Please note that
delivery times may vary based on location, shipping method, and other external factors.
Returns and Refunds
Eligibility for Return:
At NIVA, we accept return requests only if the item arrives damaged or defective. To be eligible, the product must be in its original, unworn condition, with all tags, accessories, and packaging intact.
All return requests must be initiated within 24 hours of delivery. We kindly ask our customers to record a complete unboxing video at the time of opening the parcel. This video must clearly show the unopened POD sleeve with the shipping label visible, and continue until the product is fully unboxed.
This step is crucial for us to verify any claims of transit damage or missing items. Without a valid unboxing video, we will not be able to process return or exchange requests. Please do not accept the parcel if the POD sleeve appears missing, tampered with, or damaged.
We truly value your trust, and this policy ensures a fair and transparent experience for both sides. Still images or partial videos of the product alone will not be accepted as valid proof.
How to Request a Return or Exchange:
All return/exchange requests must be made only via email to nivajewels.co@gmail.com. Please include your order number, reason for return, and the unboxing video as described above.
Our customer support team will respond within 72 hours. In some cases, we may require additional information to proceed with the request.
Non-Returnable Products:
For hygiene and safety reasons, earrings or any jewelry that pierces the skin cannot be returned or exchanged unless damaged during delivery.
Additionally, customized or personalized pieces are non-returnable and non-exchangeable.
The Return Process:
Once your return request is approved, we will provide you with either a return shipping label or detailed instructions for sending the item back. In most cases, we’ll raise a return pickup request on your behalf.
However, in rare situations where a reverse pickup service is unavailable in your area, you may be asked to ship the item back to our address in its original packaging.
Unless the item received was damaged or incorrect, the return shipping cost will be borne by the customer.
Refunds:
We do not offer monetary refunds at NIVA. Instead, we provide Store Credits which can be used toward future purchases.
Once the returned product is received and inspected, your Store Credit will be issued via email within 5–7 working days.
Shipping charges from the original order are non-refundable, except in cases where the return is due to our error (such as receiving the wrong or damaged product).
Exchanges:
If you’d prefer an exchange over a store credit, we’re happy to help—provided the item you want is in stock.
If the requested product is unavailable, we will issue a Store Credit for the same value instead.
Security of the user
Account Security: When creating an account on our website, you are responsible for
maintaining the confidentiality of your password and account information. You are fully
responsible for all activities that occur under your password or account.
Responsibility: If you suspect any unauthorized use of your account or any other
breach of security, you must notify us immediately. While we take reasonable measures
to protect the security of your account, we are not responsible for any loss or damage
arising from unauthorized access to your account.
Data Protection: We are committed to protecting your personal information and have
implemented appropriate security measures to safeguard your data. However, no method of transmission over the internet or electronic storage is 100% secure, and we
cannot guarantee absolute security.
Intellectual Property
Ownership: All content on this website, including text, images, logos, and designs, is
the property of NIVA or its licensors and is protected by copyright and other
intellectual property laws.
Use of Content: You may not reproduce, distribute, or otherwise use any content from
our website without our prior written consent.
Limitation of Liability
Disclaimer: We are not liable for any direct, indirect, incidental, or consequential
damages arising from your use of our website or purchase of products, except as
required by law.
Product Liability: Our liability for any product defect or issue is limited to the amount
paid for the product.
Governing Law
These Terms & Conditions and the relationship between the user and NIVA shall be
governed in accordance with the laws of India without reference to conflict of laws
principles.
These Terms shall be governed by and construed following the laws of India. Any
disputes arising from or related to these Terms shall be subject to the exclusive
jurisdiction of the courts at Daman&Diu and the user hereby accede to and accept the
jurisdiction of such courts.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be
posted on this page, and the "Last Updated" date will be revised accordingly. Your
continued use of our website after any change indicates your acceptance of the new
Terms.
